Terms of Service

1. Acceptance of terms

By accessing or using Your Story, Their Song ("we", "us", "the Service"), you ("Customer", "you") agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. We may update these Terms at any time, and continued use of the Service means you accept the updated version.

2. Service description

We create original, personalised songs from the details you submit through our song builder — the recipient, occasion, relationship, memories and message you share. Every song is written for one order and is unique to it.

Creative interpretation is part of the process. We work hard to capture your intent, but the finished song may differ from what you pictured based on artistic and technical decisions.

3. Pricing and payment

The base song starts at $19.99 and is stream-only. Optional add-ons — high-quality download, lyric video and keepsake card, extended version, instrumental / karaoke version, 30-second ringtone, and full ownership & commercial rights — are priced separately and shown before checkout.

All prices are in USD. Payments are processed securely by Stripe; we never see or store your full card details. You are never charged without confirming your order at checkout.

4. Delivery and access

• Songs are typically produced and delivered within 24 hours of payment.
• You track your order and stream your song from the Track Order page using your order code and email.
• Downloadable files are available only if your order includes the relevant add-on (for example high-quality download, extended version, or instrumental / karaoke version).
• Full ownership & commercial rights includes the download, lyric video, keepsake card, cover art and ringtone; it does not include the extended version or the instrumental / karaoke version.

5. Revisions

Every order includes up to 4 revisions. A revision lets you change the feeling, genre or voice, adjust the lyrics, or add a note about what to change. Requests are queued to the studio and a revised version replaces the previous one.

Revisions are for adjusting the song you ordered. A request that changes the recipient, occasion or story is a new order.

6. Refunds

Refund eligibility decreases as you use your included revisions, because studio work has already been carried out:

• Before any revision: up to 100% refund.
• After 1 revision: up to 75%.
• After 2 revisions: up to 50%.
• After 3 revisions: up to 25%.
• After 4 revisions: no refund.
• Once a refund is issued, streaming and download access to the song is revoked.

7. Intellectual property and licence

Upon full payment you receive a perpetual, non-exclusive, non-transferable licence to use your song for personal enjoyment, sharing with friends and family, non-monetised personal social posts, and personal events such as weddings, birthdays and celebrations.

Commercial use — advertising, monetised content, resale, public broadcast or any profit-generating use — requires the Full ownership & commercial rights add-on. Songs are produced with AI-assisted tools, so registrable copyright in the output may be limited. See our Licence page for full detail.

We may use anonymised excerpts of delivered songs for promotional purposes. Email us and we will opt you out.

8. Prohibited content

We screen submitted text automatically and reserve the right to refuse or cancel any order requesting content that is:

• Sexually explicit or pornographic.
• Hateful, discriminatory, or promoting violence.
• Defamatory, threatening or harassing toward any individual.
• Infringing third-party intellectual property rights.
• Otherwise illegal, dangerous or harmful.
• Involving a minor in any sexual or exploitative context.

Submissions are screened automatically at checkout and again when you request a revision or leave a review. Blocked text is rejected before an order is created, so nothing prohibited enters production. Orders cancelled for prohibited content are not refunded.

9. Your submissions

You confirm that the names, memories and messages you submit are yours to share, are accurate to the best of your knowledge, and do not violate anyone's rights or privacy. We only collect written information — we do not ask for or store photos or videos.

10. Technology and production

Our production process uses AI-assisted composition, vocal and mastering tools alongside human review. By using the Service you acknowledge and accept that technology-assisted methods are part of how your song is made.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, EMPLOYEES AND AFFILIATES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES; LOSS OF PROFITS, DATA OR GOODWILL; ANY DAMAGES EXCEEDING THE AMOUNT PAID FOR THE ORDER IN QUESTION; TECHNICAL FAILURES OR DELAYS; OR SUBJECTIVE DISSATISFACTION WITH CREATIVE OUTPUT THAT MEETS THE SPECIFICATIONS PROVIDED. The Service is provided "as is" without warranties of any kind.

12. Chargebacks and disputes

If you open a chargeback after delivery, we may provide the payment provider with evidence of delivery and access, terminate your access to the Service, and pursue the disputed amount plus fees. Please contact us first — most issues are resolved with a revision or a partial refund.

13. Indemnification

You agree to indemnify and hold harmless Your Story, Their Song and its owners, employees and affiliates from any claims, damages, losses or expenses (including legal fees) arising from your use of the Service, your breach of these Terms, or your infringement of third-party rights.

14. Governing law and disputes

These Terms are governed by applicable law. Disputes will first be addressed through good-faith negotiation; if unresolved, they will be submitted to binding arbitration or the appropriate courts, as determined by the nature of the claim.

15. Severability

If any provision of these Terms is found unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions stay in full effect.
